THE REAL LAWS OF THE “RIGHT TO KEEP AND BEAR ARMS” IN MAINE

By Phil Merletti

“I have been asked by legislators, law enforcement, lawyers and Maine voters who are confused as to the legitimacy of the 3rd referendum question and whether or not, it is Constitutional.

“An Act to Require Background Checks for Gun Sales and Transfers”

On the surface, the question seems innocuous and logical. I am going to by-pass the socialist propaganda and agenda, the anger, personal opinions and emotion driven discussions and ignorance of the United States and Maine Constitutions from both opponents and proponents. As a believer in the authority of the United States and Maine Constitutions, I am compelled to refer to both of them for answers and final direction rather than be redirected by past precedent, rules, regulations or statutory laws that are repugnant to the United States or Maine Constitutions.”

Constitution of the State of Maine (1988) Amendment to Clarify the Original Constitutional Resolution Making the Language of the Constitution Gender-Neutral

Courtesy of Lise from Maine

Constitution of the State of Maine (1988) – Amendment

Constitution of the State of Maine (1820)

The so-called amendment of 1988 pertaining to making the language of the constitution gender-neutral is absolute fraud and treason.

Why is that?

First of all, you have to look at the “original” Constitution of the State of Maine (1820) in order to understand “how” the constitution can be amended lawfully. You won’t find this in the “statutory” constitution of 2013 so you have to examine the “origin” of changing the constitution lawfully.

In Article 10, Section 4 it states: “The Legislature, whenever two thirds of both houses shall deem it necessary, may propose amendments to this Constitution; and when any amendment shall be so agreed upon, a resolution shall be passed and sent to the selectmen of the several towns, and the assessors of the several plantations, empowering and directing them to notify the inhabitants of their respective towns and plantations, in the manner prescribed by law, at their next annual meetings in the month of September, to give in their votes on the question, whether such amendment shall be made; and if it shall appear that a majority of the inhabitants voting on the question are in favor of such amendment, it shall become a part of this Constitution.”

Take notice of the last part of this article and section where it says that “if it shall appear that a majority of the inhabitants voting on the question are in favor of such amendment, it shall become a part of this Constitution.”

This means that the amendment “itself” MUST (must is mandatory) become a part of the constitution if the inhabitants voting are in favor of it.

Also notice that it says NOTHING about any Chief Justice arranging and rearranging or omitting anything in the constitution plus it says NOTHING
about having the “approval” of the legislature as the 1875 unlawful amendment says. Since 1876 when the 1875 amendment went into effect, the constitution was codified unlawfully, and all constitutions have been codified fraudulently since then.

What the unlawful 1988 amendment does, in fact, is change most of the constitution where the language refers to the male gender such as his, men
and so forth. Even the preamble has been changed from “His” to God’s.

How can this amendment “itself” become part of the lawful constitution?

It cannot as it is an impossibility prescribed by constitutional law.

Furthermore, is it “really” an amendment?

No, it is not.

In fact, most of the constitution was changed to be gender-neutral, and this is unlawful.

What the legislature could have done lawfully is propose an amendment to “include” women in the constitution and have “that” amendment, if approved, become a “part” of the constitution itself.

Thank you!

Maine Governor Paul LePage To Submit Legislation Giving Power To The Governor To Appoint The Attorney General And State Treasurer

Pine Tree Watchdog reports “Gov. Paul LePage plans to submit legislation this session that would create the state’s first lieutenant governor, do away with the secretary of state position and give the power to appoint the attorney general and treasurer to the governor.

Although the bill has yet to be submitted, the Maine Center for Public Interest Reporting has exclusively confirmed its rough outline with the governor’s office and the current secretary of state, Matthew Dunlap.

The changes would require an amendment to the state constitution, which needs a two-thirds vote of the legislature and two-thirds approval in a voter referendum.

The governor’s office confirmed it is drafting legislation that would not only make that change to the state’s constitution, but would also change how two other constitutional officers are appointed. LePage wants the governor, not the legislature, to name the attorney general and state treasurer.

Gov. Paul LePage Is On The Right Track With Changes To The Attorney General’s Office…But He’s On The Wrong Train

BDN reports “Gov. Paul LePage on Thursday outlined a second-term agenda that ranged from reviving welfare reform proposals that have previously failed to a new initiative aimed at weakening the attorney general’s power.

Changes to the attorney general’s office. LePage and Democratic Attorney General Janet Mills have clashed repeatedly since she was elected to the post two years ago when Democrats regained legislative majorities. LePage said he will pursue legislation to make the position — and possibly the state treasurer and secretary of state, which are also elected by legislators — subject to a statewide vote.”  Read more HERE.

Having a state-wide vote of the attorney general would be in violation of the original Constitution of Maine (1820), ARTICLE V. PART FIRST. EXECUTIVE POWER. Section 8. The only lawful process to achieve the Governor’s goal is for Governor LePage to declare the 1855 resolve to be unlawful as well as null and void. This is the resolve whereby the legislature stole from the Executive department the ability of the governor with the advice and consent of the council to nominate and appoint the attorney general. This is an Executive department function as provided by the original constitution. The attorney general has been unlawfully elected by the legislature since 1856 when the 1855 resolve went into effect.

1855 Resolve

We can hope that the legislators, and the Governor, read, study and understand the constitution in which they took their oath to uphold. Then they, and we the people, can get on board with Governor LePage when the train leaves the station.

Election 2014: Keep It Simple, It’s The Constitution

10/20/14

“Here we go again, another election year and now we suffer the one sided, one issue sentiments that fill the opinion pages to ad-nauseam! Don’t people get it, even though a person has emotions and one sided issues that a candidate shares, does not a good candidate make.

Tom Jefferson said (and I generalize): ”The greatest detriment to a republic is a two party system”. What did he mean? His fear was that people would place more trust in their party ideology than a government with honest and truthful legislators. So why would an elector today cast their vote just because a candidate belongs to the elector’s party?

The problem is the electors today do not investigate or vet their candidates, they know absolutely nothing about the candidate and they are swayed and fooled with lies, what they see, hear, their emotions and their party. This is why we continue to lose our national and state governments and our unalienable rights.

Why has this happened and this is not just opinion! When a Representative is voted into office, they must swear or confirm an Oath. Article VI of the U.S. Constitution, Paragraph four reads: The Senators and Representatives before mentioned, and the members of the several states legislatures, and all executive and judicial officers, both of the United States and of the several states, shall be bound by Oath or Affirmation, to support this Constitution (United States);

Article IX, Section 1 of the Maine Constitution, is apparently clear: ‘Every person elected, appointed, or commissioned to any judicial, executive, military or other office under this State, shall, before entering on the discharge of the duties of that place or office, take and subscribe the oath or affirmation: to support the Constitution of the United States and of this State (Maine).’

This means to us, that we trust the legislators to make all laws according to the U.S and Maine Constitutions. The Maine Constitution confirms this in Article IV part third, it says: The Legislature, …….., shall have full power to make and establish all reasonable laws and regulations for the defense and benefit of the people of this State, NOT REPUGNANT TO THIS CONSTITUTION, NOR TO THAT OF THE UNITED STATES.

Now what does all that mean. It means that the Congressmen and our Maine Legislators must make laws that will benefit and defend ALL the people. That does not mean that government laws and rules could line the pockets of corporations, their lobbyist, legislators, governors, congressmen, judges, or lawyers. That does not mean that the power and control can be stripped from the people by laws that take money from the people and then transfer the money, power and control by felonious laws!

There are two main problems. First of all, all of the Candidates, the Congressmen, the Governor and the legislators refuse to read, study & follow the U.S. and Maine Constitutions. This summer we provided six symposiums for them to attend the presentations, but both parties put out the word to ignore this opportunity. Secondly, by Constitutional law, once an elected person knows and understands the Constitutions and they willfully violate it, it could be considered “TREASON”.

Now you know why they refuse to study the Constitutions; vote accordingly!”
